Article 2 — Scope

These terms govern distance sales of new products made through the website between Laydown and consumers acting for purposes outside their trade or profession. They apply to the watches, accessories, jewellery and gift cards actually offered.

The customer acknowledges having read these terms before confirming the order. Confirmation constitutes acceptance of the terms in force on the order date. The customer may retain or print a copy, which is also supplied with the order confirmation on a durable medium.

Article 3 — Capacity

The customer represents that they have the legal capacity to enter into the contract. A minor may order only with the authorisation and under the responsibility of their legal representative.

Article 4 — Products

Each product page presents the essential characteristics, price, variants and availability. The customer must check them before ordering.

Photographs and visuals are intended to represent the product faithfully. Minor display differences caused by screens or lighting do not constitute a lack of conformity where the advertised essential characteristics are respected.

Offers remain valid while visible and available. Laydown does not offer pre-orders unless they are expressly introduced in the future with a dedicated delivery window.

Article 5 — Orders

The customer selects the products, reviews the basket, enters contact details, chooses delivery and payment, and then confirms the order through a button clearly indicating the obligation to pay.

A confirmation is sent to the email address provided. Laydown may request reasonable verification or cancel an order in the event of suspected fraud, refused payment, unavailability, an obvious pricing error, unusually high quantities, insufficient contact details or inability to deliver. Amounts collected for a cancelled order will be refunded without undue delay.

Article 6 — Prices, currencies and taxes

Prices are displayed in the currency of the selected market. The total amount payable, including taxes collected by Laydown and any delivery charge, is shown before final confirmation.

The invoiced price is the price shown when the order is placed, except for an obvious error that the customer could not reasonably have failed to notice. Import charges not collected at checkout are governed by the Shipping Policy.

Article 7 — Payment

Payment is due immediately when the order is placed. The methods actually available — including bank cards through Shopify Payments, Shop Pay and PayPal — are displayed at checkout. Laydown does not directly store full bank-card details.

Payment is subject to the checks and terms of the relevant provider. If it fails or is refused, the order is not finally accepted.

Article 8 — Gift cards, promotions and store credit

Promotional codes are subject to the conditions announced with the offer, may not be combined unless stated otherwise and cannot be converted into cash.

Laydown gift cards are valid for twelve months from issue. They may be used up to their remaining balance and cannot be exchanged for cash, subject to mandatory law. A refunded purchase originally paid with a gift card is credited back using the same method.

Article 9 — Delivery

Applicable areas, charges, methods, logistics origin and timeframes are stated in the Shipping Policy and at checkout. Orders may be dispatched from the logistics centres of Laydown's suppliers located outside France. Laydown remains contractually responsible for proper performance of the sale.

Risk passes to the customer when the customer, or a third party designated by the customer, takes physical possession of the product, unless the customer selected a carrier not offered by Laydown.

Article 10 — Right of withdrawal

The consumer has fourteen calendar days from receipt to notify the decision to withdraw. The goods must then be returned within fourteen days after that notice.

The procedure, address, costs, expected condition and standard form are set out in the Return and Refund Policy.

For a change of mind, the direct return costs are borne by the customer. Where the whole order is withdrawn, Laydown refunds the purchase price and the original standard delivery charge. Any express supplement is not refunded beyond the standard rate.

Article 11 — Statutory guarantees and Laydown Care

Consumers benefit from the statutory guarantee of conformity and the guarantee against hidden defects. These rights apply independently of Laydown Care.

Your statutory guarantees

The consumer has two years from delivery of the goods to obtain implementation of the statutory guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to establish the existence of the lack of conformity, not when it appeared.

Where the sale provides for the continuous supply of digital content or a digital service for more than two years, the statutory guarantee applies to that content or service throughout the agreed supply period. During that period, the consumer only has to establish the existence of the lack of conformity affecting the content or service, not when it appeared.

The statutory guarantee of conformity requires the professional, where applicable, to provide all updates necessary to maintain the conformity of the goods.

The statutory guarantee of conformity entitles the consumer to repair or replacement within thirty days of the request, free of charge and without major inconvenience.

If the goods are repaired under the statutory guarantee of conformity, the consumer benefits from a six-month extension of the original guarantee.

If the consumer requests repair but the seller imposes replacement, the statutory guarantee of conformity is renewed for two years from the replacement date.

The consumer may obtain a reduction in the purchase price while keeping the goods, or end the contract and obtain a full refund against return of the goods, if:

  1. The professional refuses to repair or replace the goods;
  2. Repair or replacement takes place after thirty days;
  3. Repair or replacement causes major inconvenience, particularly where the consumer permanently bears the cost of taking back or removing the non-conforming goods, or of installing repaired or replacement goods;
  4. The lack of conformity persists despite the seller's unsuccessful attempt to restore conformity.

The consumer is also entitled to a price reduction or termination of the contract where the lack of conformity is serious enough to justify an immediate reduction or termination. The consumer does not then have to request repair or replacement first.

The consumer is not entitled to terminate the sale if the lack of conformity is minor.

Any period during which the goods are unavailable for repair or replacement suspends the remaining guarantee until the restored goods are delivered.

These rights result from Articles L. 217-1 to L. 217-32 of the French Consumer Code.

A seller who obstructs implementation of the statutory guarantee of conformity in bad faith may incur a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).

The consumer also benefits from the guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or a full refund against return of the goods.

Laydown Care — commercial warranty

A two-year commercial warranty with replacement for covered manufacturing and material defects.

Laydown Care is included at no extra cost with new watches purchased from laydownwatches.com where this warranty is offered at the time of purchase. It applies for two years from delivery, in the original delivery country.

What is covered?

Manufacturing and material defects affecting the watch, including its movement or electronic module, display, controls, case, crystal, bracelet and clasp, identified during the warranty period under normal use.

What is excluded?

  • Normal wear, scratches and cosmetic ageing.
  • Normal battery depletion.
  • Loss and theft.
  • Damage caused by accidents, impacts, misuse or exposure to water beyond the limits stated when you purchased the watch.
  • Damage caused by modifications or work carried out by a third party.

These exclusions apply only to Laydown Care and do not restrict your statutory rights.

Replacement

After reviewing your claim and confirming a covered defect, LAYDOWN replaces your watch with a new watch of the same model and colour, subject to availability. If that reference is unavailable, a watch with equivalent characteristics may be offered with your agreement.

The replacement, its delivery and any return requested by LAYDOWN are free of charge. Laydown Care does not provide a repair service. If replacement is unavailable or you do not accept an alternative, your legal remedies remain available, including a refund where the legal conditions are met.

Make a claim

Email contact@laydownwatches.com with your order number or other proof of purchase and a description of the defect. We may request photos to help assess the problem. We will explain the next steps and provide return instructions if needed.

Remaining cover and statutory rights

A replacement under Laydown Care retains the remaining commercial warranty period, subject to statutory suspensions and extensions. If the watch is gifted or resold between consumers, the existing rights transfer with it for the remaining period.

Laydown Care is additional to the statutory guarantee of conformity and the guarantee against hidden defects. Replacement as the commercial remedy does not remove other remedies available by law. Any more protective mandatory consumer rights applicable to your purchase remain unaffected.

The guarantor is LAYDOWN, operated by the seller identified in Article 1. The full Laydown Care conditions also identify the guarantor and contact details. The applicable conditions must be supplied on a durable medium no later than delivery.

Article 12 — Complaints and customer service

Requests may be sent to contact@laydownwatches.com. Laydown aims to provide an initial response within 24 business hours, Monday to Friday excluding public holidays.

Article 13 — Liability

Laydown is responsible for proper performance of its obligations in accordance with applicable law. Its liability cannot be excluded or limited in relation to statutory guarantees, personal injury, gross negligence or intentional misconduct, or in any other case where limitation is prohibited by law.

Laydown is not liable for indirect loss or failure caused exclusively by the customer, the unforeseeable and unavoidable act of a third party to the contract, or an event of force majeure recognised by law.

Article 14 — Personal data

The processing of personal data, its purposes, recipients, retention periods and customer rights are described in the Privacy Policy. Customers may manage their cookie preferences at any time through the link provided on the website.

Article 15 — Intellectual property

The website, trade mark, logo, texts, photographs, videos, graphics and Laydown creations are protected. No right of reproduction, exploitation or commercial use is granted beyond personal use of the website, unless prior written permission is given or a statutory exception applies.

Article 16 — Governing law and disputes

These terms are governed by French law, without depriving a consumer residing in another country of any more protective mandatory provisions applicable in the consumer's country of residence.

If no amicable solution is reached, the consumer may bring proceedings before the court having jurisdiction under the applicable statutory rules. The European online dispute resolution platform, which closed on 20 July 2025, is not presented as a dispute-resolution channel.

Consumer mediation

In accordance with the provisions of the French Consumer Code concerning the consumer dispute mediation process, after contacting us and if you have not received a satisfactory response, you may use a consumer mediation procedure free of charge through:
